Welcome to Haterkache.app (the "Platform", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Haterkache.app website, mobile applications, and integrated services (collectively, the "Services").
By accessing, browsing, or using our Services, you ("User", "Customer", "Merchant", or "Delivery Partner") agree to be bound by these Terms. If you do not agree, please refrain from using the Platform.
1. About the Platform
Haterkache.app is a multi-service digital marketplace that operates across four primary modules:
1. Shop: Multi-vendor e-commerce for retail goods.
2. Food: Food ordering and delivery from registered restaurants.
3. Grocery: Daily essentials and grocery delivery from local stores.
4. Parcel: On-demand logistics and intra-city parcel pick-up and drop-off services.
Haterkache.app acts as a facilitator connecting Users, independent Merchants (Shops/Restaurants/Grocery Stores), and Delivery Partners.
2. Account Registration and Security
● Users must be at least 18 years old, or access the Platform under the supervision of a parent or legal guardian.
● You must provide accurate, current, and complete information during registration.
● You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Module-Specific Terms
A. Shop & Grocery Modules
● Product Information: Merchants are responsible for the accuracy of product descriptions, pricing, and stock availability. Haterkache.app does not guarantee that descriptions are error-free.
● Pricing: Prices are subject to change without prior notice. Taxes and delivery fees will be calculated at checkout.
B. Food Module
● Order Acceptance: Once a restaurant begins preparing a food order, it cannot be canceled or modified by the user.
● Allergies & Dietary Restrictions: Users must contact the restaurant directly regarding food allergies. Haterkache.app is not liable for any health issues arising from food preparation.
C. Parcel Module
● Prohibited Items: Users strictly agree NOT to send illegal items, hazardous materials, weapons, currency, high-value jewelry, or contraband via the Parcel service.
● Inspection: Delivery partners or Haterkache.app reserve the right to refuse or inspect any parcel if suspicious activity is suspected.
● Liability: Haterkache.app is not liable for fragile items that are poorly packaged by the sender.
4. Pricing, Payments, and Billing
● Payment Methods: We accept Cash on Delivery (COD), Mobile Financial Services (MFS like bKash, Nagad), and Digital Credit/Debit Cards.
● Delivery Fees: Delivery charges vary based on distance, order volume, weather conditions, and the specific module used.
● Taxes: All applicable government taxes and VAT will be included in the final invoice as per local regulations.
5. Cancellation, Return, and Refund Policy
● Cancellation: Orders can only be canceled before they are accepted or prepared by the Merchant/Delivery Partner.
● Returns (Shop/Grocery): Products can be returned if they are damaged, defective, or incorrect upon delivery. Shop items may be returned within 7 days of delivery; grocery items must be reported at the time of delivery, in accordance with our Refund & Return Policy.
● Refunds: Approved refunds will be processed via the original payment method or credited to the platform wallet within 7-10 business days.
6. Advertising
The Platform may display advertisements, including personalized ads served through third-party advertising partners such as Google AdMob. These ads may use your device's advertising identifier as described in our Privacy Policy. Haterkache.app is not responsible for the content, accuracy, or offers made in third-party advertisements, and any dealings with advertisers are solely between you and the advertiser. You can manage ad personalization through your device settings.
7. Intellectual Property
All content on the Platform - including the Haterkache.app name, logo, trademarks, text, graphics, and software - is the property of Haterkache.app or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written permission. By submitting reviews, ratings, or other content, you grant Haterkache.app a non-exclusive, royalty-free license to use, display, and distribute that content in connection with the Services.
8. Limitation of Liability
● Haterkache.app does not manufacture goods, cook food, or own the grocery stores. Therefore, we are not liable for the quality, safety, legality, or availability of products provided by third-party Merchants.
● We strive to ensure timely deliveries, but we are not responsible for delays caused by traffic, weather, political unrest, or other Force Majeure events.
9. User Code of Conduct
Users agree not to:
● Misuse the platform to place fake orders or fraudulent parcel requests.
● Harass, abuse, or misbehave with Delivery Partners or Customer Support staff.
● Post false reviews or engage in activities that damage the reputation of Haterkache.app.
10. Modifications to Terms
Haterkache.app reserves the right to modify, update, or change these Terms and Conditions at any time without prior notice. Continued use of the platform after changes implies acceptance of the updated Terms.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the local courts.
